We are \tconcerned about our environment and quality of life. I am hopeful \tthat in the next few minutes I can provide you with information that \twill help you decide that we as a community should not\u2026and cannot \tallow the proposed Bio-En project to be located in downtown Elmira. <\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\">Bio fuel is a good thing for the \tenvironment and economy only when located in the appropriate \tplace\u2026away from residential and retail areas. Such facilities are \tnormally located on farms\u2026close to the source of feeder stock, \tbiomass, to be used in such facilities. That makes sense. To locate \ta bio fuel plant in Elmira does not.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\">Michael Purves-Smith and I have \tpreviously met with all of you regarding this matter. We have \tprepared information to help you understand the reasons we, as \trepresentatives of many hundreds of Elmira residents, oppose this \tproject location. Some of you indicated that you welcomed our \tinformation, but understandably also want to have the benefit of the \tTownship staff reports on this issue. Therefore, I would like to \tprovide you with the highlights of previous reports from the \tWoolwich Township staff along with some additional materials. In \tsummary, the objections of the staff are the same as those of the \tresidents of Elmira.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><span style=\"text-decoration: underline;\"><strong>Zoning<\/strong><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><strong>March 31, 2009 Report E25-2009<\/strong><\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\"><strong>Quote:<\/strong><\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\"><em>The subject property is designated \t\u201cIndustrial\u201d in the Township of Woolwich Official Plan and is \tlocated in the \u201cNorth-east Policy Area\u201d. The policies which \tapply to the North-east Policy Areas include Section 7.8.14.2 (a) \t(i) which states in part:<\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<p>\u201c<span style=\"font-family: Times New Roman;\"><em>a) Prior to consideration of \tthe development of this area for industrial uses the following \tstudies shall be undertaken to the satisfaction of the Township:<\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><em>i) A Land Use Study examining \tthe compatibility of the proposed development with the existing \tresidential development within the High Street Policy Area, \tpotential buffering options and alternative development options for \tthe lands subject to the application\u201d<\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<\/dl>\n<dd><span style=\"font-family: Times New Roman;\">(Has that Land Use Study been \t\t\taccomplished? If so what are the results? If not why not? And when \t\t\twill it be accomplished?)<\/span><\/dd>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><strong>Quote:<\/strong><\/span><\/p>\n<dd> <span style=\"font-family: Times New Roman;\"><em>The subject property is zoned \u201cM1 \t\tIndustrial\u201d by the Township\u2019s Comprehensive Zoning By-law \t\t55-86. Uses permitted by the M1 zone include \u201cany manufacturing, \t\tfabricating, assembly, processing, repair, indoor storage or \t\twarehousing, distribution or transportations operation\u201d. However, \t\tthese uses must also be a \u201cdry industry\u201d as defined by the \t\tBy-law. A dry industry is defined as \u201cany industry that does not \t\tuse water as part of an industrial process, but the foregoing is \t\tnot meant to include water used for sanitary needs of the \t\temployees\u201d In addition; the M1 zone also prohibits the following \t\tuses<\/em><\/span><\/dd>\n<dd>\n<\/dd>\n<dd>\u201c<span style=\"font-family: Times New Roman;\"><em>a) A use which is or may \t\tbecome obnoxious, offensive, or dangerous by reason of the \t\tpresence, emission or production in any manner of odour, dust, \t\tsmoke, noise, fumes, vibration, refuse matter or water-borne \t\twastes.<\/em><\/span><\/dd>\n<dd>\n<\/dd>\n<p><span style=\"font-family: Times New Roman;\"><em>(b) The recycling of animal, \toil, or waste products, a rendering plant, abattoir or slaughter \thouse.\u201d<\/em><\/span><\/p>\n<dd>\n<\/dd>\n<p><span style=\"font-family: Times New Roman;\"><em>Initially, the Planning Section \tof the Engineering and Planning Services Department believed that \tthe proposed bio-gas power generation facility conformed with the M1 \tzoning on the subject property. However, this determination had been \tmade based on information provided by the applicant that indicated \tthat the only water required by the facility was required for \temployee washrooms. When it was subsequently determined that the \tfacility\u2019s processing of organics required approximately 1,200 \tcubic metres of water per year the applicant was advised that the \tbio-gas facility no longer met the definition of a dry industry and \tthat a zone change would be required in order for the use to be \tpermitted. \u2026<\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<dd><span style=\"font-family: Times New Roman;\">(Note: I don\u2019t know what was \t\tused to determine that 1200 cubic meters, but I don\u2019t think it \t\tincluded cleaning each truck after it dumped its load)<\/span><\/dd>\n<dd>\n<\/dd>\n<p><span style=\"font-family: Times New Roman;\"><span style=\"text-decoration: underline;\"><strong>Storm water, Firefighting and \tHeat<\/strong><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><em>Township staff notes the \tfollowing key points in respect to these submitted plans:<\/em><\/span><\/p>\n<ul>\n<li><span style=\"font-family: Times New Roman;\"><em>The proposed storm water facility is \tdesigned to be a fire reservoir for firefighting purposes; however \tstorm water is also proposed to be collected and used as part of the \toperation. Having two sources rely on the pond for water is a \tconcern. Utilizing a storm water management facility as a fire \treservoir is problematic at the best of times and with the storage \tpond volumes competing with additional water uses, staff does not \tsupport the storm water management facility being used as a fire \treservoir. <\/em><\/span><\/li>\n<li><span style=\"font-family: Times New Roman;\"><em>The plans do not show the \tproposed lines for running the heating to any other surrounding \tindustrial use. <\/em><\/span><span style=\"font-family: Times New Roman;\"><strong>End \tQuote<\/strong><\/span><\/li>\n<\/ul>\n<dd>\n<\/dd>\n<dd><span style=\"font-family: Times New Roman;\">The plans do not show a proposed \t\tline for selling the heat produced by the process because there are \t\tno buyers in this location. The application makes reference to the \t\tElmira Pet Food plant as a potential customer for the heat, but \t\tafter speaking personally with one of the owners of Elmira Pet Food \t\tI can tell you that they have no intention of buying the heat from \t\tBio-En.<\/span><\/dd>\n<dd>\n<\/dd>\n<dd><span style=\"font-family: Times New Roman;\"><span style=\"text-decoration: underline;\"><strong>Odor<\/strong><\/span><\/span><\/dd>\n<dd>\n<\/dd>\n<dd><span style=\"font-family: Times New Roman;\"><strong>Quote<\/strong><\/span><\/dd>\n<dd>\n<\/dd>\n<p><span style=\"font-family: Times New Roman;\"><em>With regard to odour, this \tdetermination was based on information submitted by the applicant \tthat provided some assurances, but was also based on a willingness \tto rely on the Ministry of Environment\u2019s Certificate of Approval \tprocess to ensure that odour would not be a problem. The Planning \tSection is now of the view that there is a responsibility for the \tTownship to reach its own conclusions with respect to odour in order \tto finally determine whether the proposed use satisfies the section \tof the zoning By-law prohibiting uses that are, or might become, \tobnoxious, offensive or dangerous because of odour. The requirement \tfor a zone change created by the fact that the use is not a dry \tindustry provides a good opportunity to address the odour issue.<\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><em> With regard to recycling of \twaste products, the Planning Section\u2019s determination that the \tproposed bio-gas facility did not involve the recycling of waste \tproducts was initially based on an interpretation of the By-law \twhich suggested that recycling involved the conversion of waste \tproducts into an intermediary product which would then be processed \tagain in order to produce a final product. If the processing of \twaste products results in a final product, then the processing would \tnot be considered recycling. This interpretation had been used in \tthe past to permit uses similar to the proposed bio-gas facility and \thad, therefore, become something of a precedent. However, in \tconsidering the issue again, the Planning Section is now of the view \tthat the previous interpretation of what was meant by recycling \twithin the Zoning By-law was too narrow an interpretation and that \tthe intent of the By-law was to acknowledge that the recycling of \twaste products often brings special concerns with it that require \tspecial scrutiny within the land use planning process. In order to \ttrigger the land use planning process and ensure this special \tscrutiny, a broader concept of what constitutes recycling of waste \tproducts is necessary.<\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><em> Conclusion<\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><em> Staff are now of the view that, \tin order for the proposed bio-gas power generation facility to be \tpermitted at the subject location, a rezoning is required not only \tto address the dry industry aspect of the Zoning By-law, but also to \taddress the prohibition of uses that are, or may become, obnoxious, \toffensive or dangerous by reason of odour (etc.) and the prohibition \tof uses that involve the recycling of waste products.<\/em><\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\"><strong>End Quote<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">I believe that livestock manure, \toils and greases, <\/span>animal fats (glycerin), <span style=\"font-family: Times New Roman;\">and \torganic solids skimmed from dissolved air flotation (DAF) would fall \tunder the definition of \u201cwaste product\u201d which means that the M1 \tzoning prohibits this activity on this land.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">In addition<\/span><span style=\"font-family: Times New Roman;\"><em> to<\/em><\/span><span style=\"font-family: Times New Roman;\"> the staff concerns let me \tmention a few others.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">The consulting firm of <\/span><span style=\"font-family: Times New Roman;\"><strong>WIP \tRenewable Energies<\/strong><\/span><span style=\"font-family: Times New Roman;\">, located \tin Munich, is in the business of consulting on the selection of \tlocations for, building of, and operation of bio-fuel facilities. \tThe document from which I will quote has been provided on the CD, \tprepared by Michael Purves-Smith, and given to all Council members. \tQuoting from the WIP Renewable Energies document <\/span><span style=\"font-family: Times New Roman;\"><em><strong>Guidelines \tfor Selecting Suitable Sites for Biogas Plants (<\/strong><\/em><\/span><span style=\"font-family: Times New Roman;\">4 \tApril 2008, p. 14)<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><span style=\"text-decoration: underline;\"><strong>Location near biomass<\/strong><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><strong>Quote:<\/strong><\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\"><em>The first step is to select suitable \tregions for biogas production. Suitable regions are defined by the \tavailability of biomass. Due to the low energy content per volume \tand large quantities it is economically and energetically usually \tnot useful to transport liquid agricultural feedstock further than 5 \tkm, and stackable energy crops not more than 15  km. Thus, a biogas \tplant should be located in a radius of less than 15 km from the \tavailable biomass sources. Also the digestate which is usually used \tas fertilizer for feedstock production should not be transported \tfurther than 15 km due to increasing transport costs.<\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><em>Emissions, particularly <\/em><\/span><span style=\"font-family: Times New Roman;\"><em><span style=\"text-decoration: underline;\"><strong>smell \tand noise emissions cannot be avoided<\/strong><\/span><\/em><\/span><span style=\"font-family: Times New Roman;\"><em>. \tThus, the site has to be selected in view to possible conflicts with \tneighbouring areas.<\/em><\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\"><strong>End Quote<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><span style=\"text-decoration: underline;\"><strong>This location is NOT suitable \tto \u201creal green energy\u201d<\/strong><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">I believe that Bio-En will be hard \tpressed to find supplies of biomass within 15 km of this site \tadequate to keep this facility running.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><span style=\"text-decoration: underline;\"><strong>Traffic and Emissions<\/strong><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">Going by the application submitted \tby Bio-En we are told that the company is requesting authority to \tadd 80 diesel trucks per day (we believe that to be 80 in and 80 out \tadding up to160 trucks\/day) to the already overcrowded Arthur and \tChurch streets.  Bio-En has stated that the number of trucks will be \tless, but we can only go by what they have in their application and \twhat would be approved\u2026why would they ask for approval of 80 \ttrucks if they have no intention of utilizing 80 trucks?  The noise \tof the heavy trucks is bad enough, but couple that with the fumes of \tthe diesel engines and the waste products that will be hauled \twithout an air tight cover and you have a one-two knockout punch to \tthe value of property and quality of life in Elmira. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">Research on diesel fumes and health \thas been conducted in most of the developed countries of the world \tand studies are readily available from Canada, several of the states \tin the United States, the Netherlands, Sweden, and the United \tKingdom to name only a few. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">Let me read an excerpt from an \tabstract from just one such study:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><em>Diesel and Health in America: \tThe Lingering Threat<\/em><\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\"><em>Howard Frumkin, M.D.           Emory \tUniversity<\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><span style=\"font-size: medium;\"><strong>Quote<\/strong><\/span><\/span><\/p>\n<p><span style=\"color: #231f20;\">\u2026<span style=\"font-family: Times New Roman;\"><em>we (are) \tbeginning to understand the impacts of one of the most toxic sources \tof emissions today \u2013 the diesel engine. Diesels churn out a \thazardous mix of gaseous and particle pollutants. What\u2019s more, \tdiesel exhaust is emitted at ground level \u2013 where we breathe it \u2013 \tby trucks and buses around us in traffic, at school and transit bus \tstops, and by heavy construction or agricultural equipment. Diesel \texhaust contains numerous dangerous compounds, ranging from \trespiratory irritants to carcinogens including a host of air toxics, \tparticulate matter, carbon monoxide and nitrogen oxides.<\/em><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #231f20;\"><span style=\"font-family: Times New Roman;\"><em>Furthermore, <\/em><\/span><\/span><span style=\"color: #231f20;\"><span style=\"font-family: Times New Roman;\"><em style=\"background:yellow;\">research \ton personal exposures demonstrates that these small particles easily \tpenetrate our <\/em><\/span><\/span><span style=\"color: #231f20;\"><span style=\"font-family: Times New Roman;\"><em style=\"background:yellow;\"><span style=\"text-decoration: underline;\">indoor \tenvironment where they may be trapped for days when ventilation is \tpoor.<\/span><\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #231f20;\"><span style=\"font-family: Times New Roman;\"><em>The U.S. \tEnvironmental Protection Agency\u2019s Science Advisory Board (SAB) \tfinds that <\/em><\/span><\/span><span style=\"color: #231f20;\"><span style=\"font-family: Times New Roman;\"><em style=\"background:yellow;\">approximately \t21,000 people die prematurely each year due to particulate matter \tpollution from diesels.<\/em><\/span><\/span> <span style=\"color: #231f20;\"><span style=\"font-family: Times New Roman;\"><em style=\"background:yellow;\">Other \tserious adverse health impacts include tens of thousands of heart \tattacks, asthma attacks, and other respiratory ailments that can \tlead to days missed at work and at school.<\/em><\/span><\/span><span style=\"color: #231f20;\"><span style=\"font-family: Times New Roman;\"><em> Using more highly time-resolved studies we are increasingly able to \tunderstand the inflammation mechanism by which particles can lead to \tatherosclerosis, heart attacks, strokes and ultimately, untimely \tdeaths. From all we know today, we can confidently say that reducing \tdiesel exhaust in our environment will mean improving public health, \tand as this report demonstrates, reducing preventable premature \tdeaths. <\/em><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><span style=\"text-decoration: underline;\"><strong>Noise<\/strong><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">In addition to diesel air pollution \tthese trucks are sources of noise while transporting waste \tmaterials, idling while in line to dump their load, and being \tcleaned up after dumping their loads.  Adding to the noise pollution \tis the methane gas flare and two diesel engines running to produce \tthe electricity.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><span style=\"text-decoration: underline;\"><strong>Odor<\/strong><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">Remember the consulting firm WIP \tRenewable Energies of Munich states the fact that <\/span><span style=\"font-family: Times New Roman;\"><strong>odor<\/strong><\/span><span style=\"font-family: Times New Roman;\"> Quote:\u201c\u2026<\/span><span style=\"font-family: Times New Roman;\"><span style=\"text-decoration: underline;\"><strong>cannot be \tavoided<\/strong><\/span><\/span><span style=\"font-family: Times New Roman;\">.\u201d <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">When transporting kitchen and food \tprocessing wastes from restaurants, grocery stores, food \tdistribution companies and milling facilities, livestock manure, \tfats, oils and greases, and organic solids skimmed from dissolved \tair flotation (DAF) tanks to the proposed facility through downtown \tElmira and while these trucks are waiting in line to dump their load \tat the facility on hot summer days there will be an unavoidable \tfragrance in the air above the greater area of Elmira.  Most of us \thave had the experience of driving behind a garbage truck and trying \tto hold our breath until we could turn or the truck turned\u2026now \timagine that all the time and no escape. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">Just imagine the Maple Syrup \tFestival on a day when the air quality in Elmira is especially \tpungent\u2026I fear it will not be the sweet smell of a successful \tMaple Syrup Festival.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">Of course, the Green Energy and \tGreen Economy Act 2009 came along and the Council at that time \tbasically dropped involvement giving all approval authority to the \tProvince. It is my belief, and that of hundreds of other Elmira \tresidents, that the Township should not be and is not left out of \tthe process. The Township Council has a right and responsibility to \tmake the wishes of the people of Elmira known to the Ministry of \tEnvironment and stand for the people it represents.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">One last quote from the staff:<\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\">Engineering and Planning Services       \t    March 23, 2010         Report E27-2010    P.5<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\"><strong>Quote:<\/strong><\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\"> <\/span><span style=\"font-family: Times New Roman;\"><em>\u2026As \twas expressed in Report E25-2009, staff has concerns as to the \tsuitability of the proposed site for a biogas power generation \tfacility given the proximity of the residential uses on both Arthur \tand High Streets. Given these concerns, the Township requests that \tthe Ministry of the Environment review the suitability of the \tlocation for such a facility. Such a review should include reference \tto MOE industrial separation distance guidelines. If mitigation is \tthen necessary, the first form of mitigation that should be \tconsidered is <\/em><\/span><span style=\"font-family: Times New Roman;\"><em><span style=\"text-decoration: underline;\"><strong>avoidance<\/strong><\/span><\/em><\/span><span style=\"font-family: Times New Roman;\"><em>, \tbeing that the facility is located to avoid the impacts. <\/em><\/span><\/p>\n<p><span style=\"font-family: Times New Roman;\"><strong>End Quote<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">In review, the following are some \tof the reasons that the residents of Elmira stand united against the \tproposed location of the Bio-En facility: <\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-family: Times New Roman;\">Odor<\/span><\/li>\n<li><span style=\"font-family: Times New Roman;\">Noise<\/span><\/li>\n<li><span style=\"font-family: Times New Roman;\">Violation of Township Zoning By-Laws \tand disregard for Official Township Plans for \tresidential \tdevelopment<\/span><\/li>\n<li><span style=\"font-family: Times New Roman;\">Inadequate water supply for fires and \tcleaning and operations<\/span><\/li>\n<li><span style=\"font-family: Times New Roman;\">On-site storage of fertilizer \tby-products<\/span><\/li>\n<li><span style=\"font-family: Times New Roman;\">Traffic impact as well as transporting \tof waste\/bio-hazardous materials through \tdowntown Elmira <\/span><\/li>\n<li><span style=\"font-family: Times New Roman;\">Air quality (from the process \titself and diesel trucks and fumes)<\/span><\/li>\n<li><span style=\"font-family: Times New Roman;\">Quality of life in Elmira now and in \tthe future affecting commercial and residential development and property values.<\/span><\/li>\n<li><span style=\"font-family: Times New Roman;\">Methane gas \texplosions (methane gas is notorious for deadly explosions: Deep \tWater \tHorizon explosion in the Gulf comes to mind and they had the \tmost recent safety \tdevices installed. We have been told that all \tthe safety procedures will be \tinstituted and all safety devices \twill be installed and there will be no \tproblems\u2026and the Titanic \tdid not sink.)<\/span><\/li>\n<\/ul>\n<dl>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">This venue does not afford me the \ttime to go on with specifics regarding our opposition to the \tproposed location of the Bio-En facility so let me close by saying \tthat we propose that this Council not sit idly by, but rather take \taction.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">We call for a traffic impact study \tto be completed prior to further consideration being given the \tBio-En facility.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Times New Roman;\">We also call for a letter from this \telected body be sent to the Ministry of Environment that delineates \tthe concerns shared by the staff and residents.
